Letter

Re.: Request for documented justification of mask mandates for your lawful and legal defence

Dear [insert principals name] and Board of Management,

This is a follow-up to [our/my] e-mail sent on 30th August 2021 with regard to [our/my son/daughter _________].  It is in relation to a campaign undertaken by TeenHeard, a national group of secondary students and parents resolved to remove all Covid 19 unlawful, unnecessary and harmful medical mandates out of schools.  This group is currently over 600 members strong and growing and we are constantly working with other national groups of health campaigners and legal groups dedicated to health freedom and liberty.

As you are aware, that August e-mail informed you personally of your potential liability for any harm, loss or injury suffered by children due to your school’s enforcement of any mask policy and/or experimental “vaccination” policy for “SARS-CoV-2” or any other medical mandates.  We note that you have nonetheless continued to implement medical mandates in your school.

As you read this e-mail, [we/I] ask you to reflect and consider two questions; firstly, do you have the supporting evidence that SARS-CoV-2 exists to JUSTIFY your implementation of measures to allegedly suppress the virus and secondly, do you have the necessary written AUTHORITY to implement such measures on children and staff in your school?

We note that the following Freedom of Information requests have been made and answered:

  1. HSE Freedom of Information request response dated the 23rd of December 2020, attached hereto (see appendix 1), confirmed that the HSE have no evidence of, nor do they hold any record of, an isolated or purified virus called “SARS-CoV-2”.  The significance of this admission by the HSE cannot be overstated and is extremely relevant to the question of the potential liability of any Principal enforcing any medical mandates, i.e. masks and/or vaccination, where the justification for such medical mandates is to protect against a virus that has never been isolated.
  2. HSE Freedom of Information request, requesting information on Mask effectiveness and safety of which the response dated 10th January 2021 is that the HSE holds no information of the same (see appendix 1).
  3. Freedom of Information request to the Department of Education (DES), requesting information for risk assessments carried out by the DES for the wearing of face coverings as well the medical and scientific expertise/research carried out to justify face coverings on students in schools (see Appendix 2).

Since that date, the HSE have not provided evidence of same, and you are now enforcing medical mandates based upon a claim, that SARS-CoV-2 exists, that the HSE cannot and will not defend. “SARS-CoV-2” merely exists as a computer model and not as an isolated virus, and now as the individual enforcing medical mandates upon children in your school, you may be deemed to be solely responsible/culpable for any claims arising therefrom.

A preliminary enquiry made by Teenheard into the question of whether or not any secondary schools in Ireland currently maintain insurance coverage for cases of injury or illness of students arising from these medical mandates suggests that no such cover exists.  Who will pay the inevitable claims should they be made?

As [mother &/or father /or guardians], [I/we] maintain and have never relinquished our exclusive authority over our children, which is a heavily protected right under the Irish Constitution.  As noted in [our/my] August 2021 e-mail, [we/I] do not consent to any school policy that affects our inalienable and invincible rights as the sole protectors of [our/my] family.  [We/I] [are/am] now requiring that you provide all of your supporting documentation which evidences the justification for and your authority to implement medical mandates upon the children in your school. [We/I] require the following documentation:

We now require:

1.        All written documentation upon which you are relying to justify the need for any medical mandates in your school in relation to SARS COV 2, including, but not limited to, any documentation relating to the successful isolation of said virus;

2.        All written documentation that you are relying upon to claim that you are legally authorised to enforce such medical mandates.

3. Your Risk Assessment done in relation to mask wearing by the children and staff in [name school].

(Bearing in mind these must be furnished in good faith, or they cannot be relied upon at a later date for defence).

For the avoidance of any doubt: This is not about you personally, it is about [our/my] children and family.  It is not [my/our] intention to harass, intimidate, offend, coerce or cause anxiety, alarm or distress. This communication and the enclosed information are presented with honourable and peaceful intentions. Hopefully, this letter will cause you to pause and reflect seriously on your central role in enforcing these medical mandates in your school and whether that role is one which you can morally or legally justify and defend.  As the FOI’s below show, the DES has not carried out their own risk assessments on face coverings and hold no information on medical/scientific research into the same.  They are using advice from the HSE who also hold no information on proven scientific advice on safety of wearing face coverings.  Are you going to continue to further implement the advice from the DES without your own due diligence knowing that there may be risks of harm and no risk assessments carried out to show benefit of face coverings?

[We/I] are now asking you to remove the mask mandate from [name school]. Please be advised that [we/I] do not intend to back down on this matter.  The health and well-being of [my/our] [son/daughter] and the children of Ireland depends upon us adults who will be upstanding for the children.  [We/I] sincerely hope that you join [me/us] in this important national endeavour.

Yours sincerely,

[Your name/names]

FOI Requests made to HSE for Isolation of the SARS-COV2, Mask Effectiveness and Mask Safety:

To: National Lead Office FOI, DP and Records Management, HSE National Communications Division, Tullamore, Co Offaly.

Dear… Request under the Freedom of Information Act 2014. Please provide me with a full, accurate and complete list of records held by the Health Service Executive (HSE) or under the authority of the HSE which describe the isolation of the SARS-COV-2 virus (Coronavirus COVID-19), taken directly from a symptomatic patient with COVID-19, where the sample was not combined or mixed with any other source of genetic material (such as, for example, monkey kidney cells or cancer cells), thereby eliminating contamination as a possible alternative source of sampling. Please note that the word “isolation” is used here in the normally understood meaning of that word, namely, the act of separating one thing from another. I am not referring to (and hence not requesting) documents where “isolation” means the preparation of a culture of something else, the performance of an amplification test (e.g. a PCR test which detects only mRNA or DNA), or to the sequencing of anything other than the viral isolate in question. If any records of the HSE match the above description, please provide enough information so that I may identify and access each record with certainty. Please provide also the title, author, date, journal, weblink etc. of any document, online or otherwise, recorded on a document held by the HSE or under its authority, which describes the isolation procedure in question. I would remind you that a full, accurate and complete disclosure is required.

Yours sincerely,

Robert Pye,

30th October 2020.

Appendix 2

Response of FOI Request made to Department of Education for risk assessments carried out on mask wearing and also for all medical and scientific research/expertise to justify mask wearing

Dear Ms. ,

I refer to your request below for access to information under the terms of the Freedom of Information Act 2014.

Your Request:

A. ANY OR ALL RISK ASSESSMENTS AT ANY TIME CARRIED OUT BY THE DEPARTMENT OF EDUCATION AND SKILLS AND/OR ITS MEMBERS AND/OR AGENTS ON THE WEARING

OF FACE COVERINGS BY CHILDREN IN SCHOOLS

B. ALL “UPDATED RESEARCH AND/OR EXPERTISE”, BOTH MEDICAL AND SCIENTIFIC,

ALLEGEDLY CARRIED OUT AND/OR RECEIVED BY THE DEPARTMENT OF EDUCATION

AND WHICH IS RELIED UPON BY THE DEPARTMENT TO JUSTIFY THE CHANGE IN

POLICY ADOPTED SINCE 7TH AUGUST 2020 CONCERNING THE WEARING OF FACE

COVERINGS BY CHILDREN IN SCHOOLS.

We have made enquiries within the Department of Education where it would reasonably be expected to find the records you seek. Our School Governance Unit have stated that the Department is not the record holder of the records you seek.

The advice was received from the Health Protection Surveillance Centre (HPSC) which is under the remit of the HSE.

You can submit an FOI Request directly to the HSE at the following link https://www.hse.ie/eng/services/yourhealthservice/info/foi/making-a-request/

Section 12(1) (b) of the Freedom of Information Act requires the requester to give ‘sufficient particulars’ to enable us identify the records you require. We are then required to take ‘reasonable steps’ to identify and locate those records.

Section 12(1) (b) of the Act provides,

12 (1) A person who wishes to exercise the right to access shall make a request, in writing or in such other form as may be determined, addressed to the head of the FOI body concerned for access to the record concerned –

(b) containing sufficient particulars in relation to the information concerned to enable the record to be identified by the taking of reasonable steps

Therefore, I would appreciate if you could provide me with any further information that you have which could help identify any records within the Department of Education that you seek. Alternatively, you may wish to consider withdrawing your request. This is entirely at your discretion and should you decide to continue with your request, it will be processed in accordance with FOI legislation.

Kind Regards,

Caroline Scully
